Professor Evan McKenzie author of "Privatopia: Homeowner Associations and the Rise of Residential Private Government' stated: "Residents in Common Interest Developments (HOA's) commonly fail to understand the difference between a regime based formally on rights, such as American civil governments, and the CID regime, which is based on restrictions."
This blog is the voice of an association member – a person who currently owns or has owned property in 4 different HOA’s; a prior elected board member; and ARC chair. During the past 20 years I have had the opportunity to participate in, observe, study and analyze the governance structure of this unregulated corporate form of government. I support most of the basic principles of common area management but I have a concern with the numerous reports of corporate mismanagement and the overreach into the personal lives of members by the associations. Another major concern is the influence, control and the outrageous litigation by the outside industry operatives. I support the movement to bring about change through education, legislation and the voice of the members. Hopefully change will eliminate the nonsensical intrusions into the personal lives of the members and restore the Constitutional and common law rights that have been taken away by the industry operatives.
